Program Overview
Although the delivery of health care has changed over time, the legal aspects of clinical practice continue to be expressed through fundamental principles. The law translates societal expectations for a physician's conduct by establishing a process to determine whether a physician's conduct has been reasonable under the circumstances. Even though the circumstances of physicians may vary, the legal implications of clinical practice are drawn from the basic legal principles explored in this course.
The clinicolegal case studies in this course examine the professional conduct of physicians are actual court cases. The course is problem-based focusing on the clinicolegal situations that arise in the course of the physician-patient encounter. By reviewing and analyzing medicolegal cases, physicians will become aware that certain events may indicate substandard care.
ELM Exchange, Inc. designates each educational activity for a maximum number of AMA PRA Category 1 Credit(s)TM. Physicians should only claim credit commensurate with the extent of their participation in the activity.
Program Objectives
- Completion of these courses will improve general competencies in clinical practice:
- To become aware of societal expectation for a physician's professional conduct
- Understand when exposure to liability is present in their clinical practice
- Recognize and prevent the factors that may cause a risk to materialize
- Respond appropriately to those clinical situations
- Evaluate the clinicolegal options available and compare their consequences
Accreditation/Credit Designation
ELM Exchange, Inc. is accredited by the Accreditation Council for Continuing Medical Education (ACCME) to provide continuing medical education for physicians.
ELM courses have been planned and produced in accordance with the Essential Areas and Policies of the Accreditation Council for Continuing Medical Education (ACCME).1
The American College of Nurse Practitioners (ACNP) and The American Academy of Physician Assistants (AAPA) accept AMA/PRA category 1 credit from organizations accredited by the ACCME.
The American Nurses Credentialing Center (ANCC) accepts AMA/PRA category 1 credit toward recertification requirements.
Target Audience
This program is intended for any practicing physician with an interest in medical liability and risk management.

This is a risk management education course that addresses the risks that arise in the clinical practice of medicine. It does not discuss specific commercial products or drugs, nor does it discuss any unlabeled drugs.
Instructions for Obtaining Credit
Participants are expected to visit all case presentations before attempting to take the test and activity evaluation. Successful completion of a unit will lead to the online issuance of a certificate category 1 credits towards the AMA Physician's Recognition Award.
Please follow these steps in order to receive CME credit for taking a course unit:
- Read all of the CME accreditation information above.
- Read the complete course unit including case study presentations.
- Complete the online test and evaluation.
- Participants must receive a passing test score and answer all evaluation questions to receive a certificate.
- After successfully completing the online test and evaluation, you may view and print your online certificate.
Hardware/Software Requirements
The ELM courses are optimized for computers running Microsoft XP or higher and using Microsoft Internet Explorer. At a minimum you must use a Netscape 4.x (or higher) or IE 4.x (or higher) browser. The browser should have the default configuration. If you have altered your browser's configuration, you must at least ensure that it accepts "cookies" and has JavaScript enabled. AOL and Safari are not supported browsers.
